These Terms of Use ("Terms") are an agreement between you and Bern Endres ("we," "us"), operator of angelicseatrav.llc (the "site"). By using the site you agree to these Terms. Members accept them when creating an account. If you do not agree, do not use the site.
These Terms include our Community Rules and our Privacy Policy, which explains how we handle personal information.
1. Who can use the site
1.1 Anyone may view the public pages.
1.2 Membership is for people 18 or older. Anyone found not to be 18 or older will be deleted from the site.
1.3 Membership requests are reviewed individually. We may approve or decline any request.
2. Your account
2.1 Give accurate information and keep it up to date.
2.2 One account per person. Keep your password private. You are responsible for activity on your account.
2.3 Tell us right away at info@angelicseatrav.llc if you suspect someone else has used your account.
3. Using the site
3.1 Follow the Community Rules whenever you post or interact with others.
3.2 Do not:
- (a) break the law, or use the site to harm others;
- (b) access accounts, data, or areas you are not authorized to use;
- (c) probe, scan, overload, or interfere with the site or its security;
- (d) scrape, copy in bulk, or harvest data from the site, including other members' information;
- (e) upload viruses or malicious code;
- (f) use the site to send spam or unsolicited advertising.
4. Vessels, logs, and documents
4.1 Only register or claim a vessel you own or are authorized to manage. Documents you upload must be genuine and yours to share. False claims or documents will result in account removal.
4.2 Vessel verification compares the information you give with U.S. Coast Guard public records and reviews your documents. A "verified" badge means only that this check was passed. It is not a legal determination of ownership, title, or seaworthiness.
4.3 Logs you keep on the site are for your own records. You are responsible for their accuracy and for meeting any record-keeping the law requires of you or your vessel. Log entries are kept as a permanent record to auditing and credibility standards, as described in the Privacy Policy. Once saved, an entry can't be edited or deleted by anyone, including us. Corrections are added as new versions.
4.4 A vessel's Captain controls who has crew access to that vessel's records.
4.5 Only names go in logs. Record people in a log by name only. Don't enter anyone's email address, phone number, home address, or other contact details in a log, including in its notes.
4.6 A vessel's history stays with the vessel. If you sell a vessel or leave it, its Ship's Log, Maintenance Log, Watch & Checklist Log, and Radio Log stay with the boat and pass to its next owner, including the names recorded in them. Your Captain's Log and Personal Logbook stay with you. The Guest Log stays with you too, unless you choose to include it when you transfer the boat. The next owner must verify ownership for themselves.
4.7 Removing a vessel. Only the vessel's owner can remove it, in one of these ways: transfer it to a new owner (the buyer must accept), leave it, report it lost or destroyed (with official proof, reviewed by us), or delete it if it was added by mistake and has no logs. Site administrators can't delete vessels. They can only reinstate a vessel after its owner asks. A vessel its owner left can be claimed by its next owner, with proof of ownership that we review.
4.8 False transfer requests, claims, or loss reports will result in account removal.
5. Your content
5.1 You own the content you post. You give us a non-exclusive, worldwide, royalty-free license to host, store, display, format, back up, and moderate it on the site, and to keep it as described in the Privacy Policy.
5.2 If you send us ideas, suggestions, or feedback, we may use them without paying you or owing you anything.
5.3 You are responsible for what you post, and you confirm you have the right to post it.
5.4 We may remove or hide content, and limit or close accounts, as described in the Community Rules.
6. Our content
6.1 All photos, videos, writing, design, and other content on the site, other than members' content, belong to us or our licensors and are protected by copyright and other laws.

7.1 The site links to other websites and services we do not control. We are not responsible for their content, products, or practices.
7.2 Some links are affiliate links: if you buy through them, we may earn a commission at no extra cost to you. They are labeled on the page where they appear.
8. Safety at sea and no professional advice
8.1 Content on the site, from us or from members, about navigation, weather, seamanship, boat systems, repairs, or travel is general information and personal experience. It is not professional, legal, or safety advice, and it may be wrong or out of date.
8.2 You and the vessel's skipper are responsible for safe operation and for decisions made on the water. Check official sources and qualified professionals.
8.3 In an emergency, call 911 or the U.S. Coast Guard on VHF Channel 16. Do not rely on the site.
9. Disclaimers
9.1 The site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement.
9.2 We do not guarantee the site will be uninterrupted, error-free, or secure, or that data will never be lost. Keep your own copies of anything important.
10. Limitation of liability
10.1 To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the site.
10.2 To the fullest extent the law allows, our total liability for any claim relating to the site is limited to the greater of $100 or the amount you paid us for the site in the 12 months before the claim.
10.3 Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, intentional misconduct, or personal injury where the law does not allow it to be limited.
11. Indemnity
To the extent the law allows, you agree to cover our reasonable costs, including attorney's fees, arising from claims by others caused by your content, your breach of these Terms, or your violation of the law or someone else's rights.

12.3 Sections 4.3, 5, 6, and 9 through 15 continue to apply after your account closes.
13. Changes
We may update these Terms. We will post the new version with its effective date and notify members on the site. Material changes apply after members accept them or continue using the site after notice. The version you accepted, and when, is recorded on your account.
14. Governing law and disputes
14.1 These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules.
14.2 Before filing any claim, please contact us at info@angelicseatrav.llc so we can try to resolve it informally.
14.3 Any dispute will be resolved in the state or federal courts located in Butte County, California, and you and we consent to their jurisdiction. Either of us may bring a claim in small claims court instead if it qualifies.
15. General
15.1 These Terms, the Community Rules, and the Privacy Policy are the entire agreement between you and us about the site.
15.2 If any part of these Terms is found unenforceable, the rest stays in effect.
15.3 If we don't enforce a part of these Terms, that doesn't waive our right to enforce it later.
15.4 You may not transfer your account or these Terms. We may transfer the site and these Terms to a successor, such as a company we form, and will notify members if we do.
